Terms and Conditions of Service
The terms governing the contracting and use of all Capa7 services. Please read them carefully: by contracting any of our services, you accept these terms.
Last updated: September 2026These Terms and Conditions govern the relationship between Capasiete Soluciones Integrales, C.A. (hereinafter "Capa7", "we" or "the Company") and any natural or legal person who contracts or uses our services (hereinafter "the Client" or "the User"). By registering, contracting or using any service, the Client declares having read, understood and fully accepted these conditions.
Acceptance and scope
These terms apply to all services offered by Capa7, including but not limited to: shared and reseller hosting, Linux and Windows VPS, dedicated, GPU and storage servers, colocation, radio and video streaming, IPTV, domain registration, SSL certificates, corporate email, licenses and software development. Each service is provided according to the specifications published for the plan selected at the time of contracting.
If a specific contract is signed with the Client for a given service, that contract shall prevail over these terms where applicable; in all other respects, these conditions remain in force.
Definitions
- Service: any product or offering contracted from Capa7.
- Account: the Client's record in our client area (WHMCS) and the associated access credentials.
- Billing cycle: the period (monthly, quarterly, semi-annual, annual or 3-year) for which a service is contracted and billed.
- Fair use: a consumption pattern compatible with the normal use of the contracted plan.
- Client area: the panel at capasiete.com/panel where the Client manages their services, invoices and data.
Contracting and account
The account is configured once payment has been received and verified. Payment processors may verify the information provided in case of suspected fraud. The Client must provide truthful data and an email address that is not associated with the domain hosted with us, to guarantee communication in case of incidents.
Providing false information of any kind will result in immediate cancellation of the account. Orders deemed high-risk may require an ID document and additional verification, or be rejected. Payments verified through PayPal may be exempt from additional verification.
The Client is solely responsible for keeping their access credentials confidential and for all activity that occurs under their account. We recommend enabling two-factor authentication (2FA) in the client area.
Prices, billing and payments
Prices are published in US dollars (USD) and may be paid in the currencies and by the methods indicated on our Payment methods page. Payments in bolĂvares are calculated at the day's EUR BCV rate.
- The invoice is issued on the 10th of each month. For renewals, the invoice is generated 7 days before the due date.
- The due date is the 20th.
- Suspension for non-payment occurs the day after the due date (the 21st) if the invoice has not been paid.
Before each due date we send up to 4 payment reminders to the registered email. It is the Client's responsibility to keep their contact details up to date to receive these reminders. Our billing department is available Monday to Friday, 8:00 a.m. to 5:00 p.m. (Miami time, EST/EDT).
Payments in bolĂvares at the EUR BCV rate are processed within 48 hours on business days and up to 72 hours on non-business days. Payments via MercadoPago carry a 10% surcharge for platform fees; other gateways may apply fees depending on the country.
Manual payment requests. When a payment method is not available in the Client's country, a manual payment request can be issued through dLocal, which supports different payment methods depending on the country. To do so, the Client may email contrerg@gmail.com (Gerson Contreras, ID 1757554249) stating the service and the amount to be paid. Capa7 never requests card details or passwords by email or WhatsApp; the dLocal payment link is processed securely on the gateway.
Capa7 reserves the right to modify prices and resource allocations at any time. Prices in bolĂvares may fluctuate according to the exchange rate. Any price change will be notified and applied from the next billing cycle.
Renewal, suspension and cancellation
Services renew automatically for the same contracted cycle, unless the Client requests cancellation before the renewal date. The renewal invoice is generated ahead of the due date.
An unpaid service is suspended the day after the due date and is deleted 7 days after the due date if it remains unpaid.
- Up to 10 days after the due date we can restore any hosting account at no additional cost.
- After that period, the restoration cost equals 6 monthly installments of the hosting plan the Client had, and contracting a hosting plan for a semi-annual or annual cycle is mandatory.
- If the Client does not wish to contract a new service with Capa7 and only wants to receive their backup, the cost is 18 monthly installments of the hosting plan they had.
Accounts cancelled for illegal activity are not entitled to a refund or to data recovery.
The Client may request cancellation of a service from the client area or via WhatsApp. Cancellation takes effect at the end of the paid cycle, with no refund of the period already billed except as provided in the guarantee section.
Guarantee and refunds
We offer a 30-day money-back guarantee on shared and reseller hosting services. If within the first 30 days the service does not meet your expectations, we refund the plan amount.
No refunds are granted for accounts cancelled for violation of these terms, for illegal activity, or for services already consumed. Coupons and discounts apply only to new clients or first-time contracts, not to domain renewals unless expressly stated, and their abusive use may result in account suspension.
Acceptable use
The Client agrees to use the services legally and responsibly, without affecting third parties or Capa7's infrastructure. The following conduct, among others, is prohibited:
- Unauthorized access to systems (hacking), phishing or identity theft.
- Distribution of malware, viruses, trojans or malicious scripts.
- Sending spam or unsolicited bulk email (see also the email section).
- Running denial-of-service attacks (DoS/DDoS) or scans against third parties.
- Any activity that degrades the service of other users or compromises the security of the network.
Prohibited content
The following content may not be hosted or distributed through our services:
- Material that infringes copyright or intellectual property, pirated software or "warez" sites.
- Child pornography (it will be reported immediately to the authorities) and any content exploiting minors.
- Content that incites hatred, is defamatory, obscene or promotes violence.
- Fraudulent schemes, HYIP, unregulated investment sites, fraudulent forex or illegal gambling.
- Sale or promotion of illegal substances.
- IRC bots, anonymous proxy pages and services designed to conceal illicit activity.
Capa7 reserves the right to suspend or cancel, without notice and without refund, any service that hosts prohibited content.
Resources and fair use
Resources described as "unlimited" (transfer, space or similar) refer to normal use within reasonable patterns. Excessive use or use incompatible with the normal use of a website is prohibited. Capa7 may suspend or limit services that consume resources disproportionately and affect other users on the same server, regardless of the contracted plan.
On VPS, dedicated and streaming plans, resources (CPU, RAM, disk, bandwidth, listeners/viewers) are those indicated in the plan specifications.
Backups
The Client is the sole responsible party for keeping up-to-date backups of their content, databases and files. Although some plans include managed backups (for example, via JetBackup) as a courtesy and operational safeguard, such copies do not replace the Client's own backups and we do not guarantee their availability or integrity in all cases.
Multiple backups stored within the hosting plan itself that consume resources disproportionately may be removed without prior notice. We recommend applying the 3-2-1 backup rule.
Availability and SLA
We work to keep our services available 24/7 and have over 17 years of operation with no significant downtime. Nevertheless, uninterrupted service cannot be guaranteed: interruptions may occur due to maintenance, equipment failure, power outages, network attacks or telecommunications failures beyond our control.
Unless a specific written SLA contract exists, Capa7 does not commit to a guaranteed availability percentage or to automatic compensation for interruptions. Scheduled maintenance windows will be announced in advance whenever possible.
Hosting and email
Shared and reseller hosting services are provided on cPanel/WHM platforms with CloudLinux. Sending email from hosting is subject to hourly limits to protect the reputation of the servers. Using email for spam, non-consented lists or unauthorized mass campaigns is prohibited and may lead to suspension.
The reseller is responsible to Capa7 for the use made by their own clients and must enforce these terms among them.
VPS and dedicated servers
On VPS and dedicated services, the Client has administrative access (root/administrator) and is responsible for the configuration, security and updating of the operating system and the applications they install, unless they contract a managed plan. Capa7 manages the physical infrastructure, network and virtualization.
Annual dedicated server contracts get a 15% discount. Dedicated servers, being exclusively assigned resources, are not covered by the 30-day guarantee. Provisioning may take time depending on hardware availability.
Colocation and datacenter
In colocation (housing) services, the Client installs their own equipment in our rack at the Cogent datacenter, Miami. The Client owns and is responsible for their hardware; Capa7 provides space, power, cooling and connectivity according to the plan (1U, 2U, 4U or other). Physical access to the datacenter is subject to prior coordination and to the facility's security rules.
Capa7 is not responsible for failures of hardware owned by the Client. The equipment must comply with the datacenter's electrical and heat-dissipation standards.
Radio and video streaming
Streaming services (AzuraCast, SonicPanel, Centova, MediaCP, Wowza, Nginx/VDOPanel) are provided according to the listener/viewer limits, bitrate, AutoDJ space and bandwidth of the contracted plan. The Client is responsible for holding the content playback licenses (music, copyright, related rights) required by the legislation of their country or market.
- Broadcasting content without the corresponding rights is not permitted.
- Relaying to networks (YouTube, Facebook, Twitch, RTMP) is subject to the policies of those platforms.
- Sustained exceeding of plan limits may require an upgrade to a higher plan.
- On radio/video reseller plans, the reseller is responsible for the use of their sub-clients.
IPTV
IPTV services and their reseller modalities are offered as a technological distribution platform. The Client and/or reseller is the sole responsible party for holding the rights, licenses and authorizations required over the content they distribute, as well as for compliance with applicable legislation on copyright and telecommunications. Capa7 grants no rights over third-party content and is not responsible for the use the Client makes of the service. Non-compliance allows immediate suspension without refund.
Domains
Domain registration, transfer and renewal are additionally governed by the policies of the registrar and of ICANN or the NIC corresponding to each extension (TLD/ccTLD). Domains are non-refundable once registered or renewed, and are not covered by the 30-day guarantee.
- The free domain, where applicable, is offered only with annual or 3-year cycle plans and under the conditions stated on the product page.
- It is the Client's responsibility to renew their domains on time; loss due to non-renewal is not attributable to Capa7.
- Domain privacy (WHOIS privacy) is an optional paid service and depends on the TLD allowing it.
- The data provided for registration must be truthful in accordance with ICANN rules.
SSL certificates and licenses
SSL certificates and software licenses (panels, operating systems, applications) are issued in the Client's name and are non-refundable once issued, nor are they covered by the 30-day guarantee. The validation of an SSL certificate depends on the Client meeting the requirements of the Certificate Authority. Licenses are subject to the terms of the corresponding manufacturer.
Software development
Software development services (web, apps, e-commerce, APIs, AI, automation) are governed by the quote and scope agreed for each project. Unless otherwise agreed, deliverables conform to the defined scope; changes outside scope are quoted separately. Delivery times depend on the Client providing the required materials and approvals on time. Intellectual property of the deliverable is transferred to the Client once the total amount is paid, except for third-party or open-source components subject to their own licenses.
Migrations
We offer an Assisted Migration service, which may carry a cost depending on complexity and data volume, quoted before starting. Capa7 makes its best effort to migrate the information without loss, but we recommend that the Client keep a full copy of their site and data before any migration. We do not guarantee the compatibility of configurations specific to the source provider.
Personal data and privacy
The Client's data is processed in accordance with our Privacy Policy. Payment information is transmitted encrypted through third-party processors; we do not store full card details on our servers. We do not share the Client's personal information with third parties outside the provision of the service, except upon legal requirement from a competent authority.
By uploading content to our servers, the Client grants Capa7 the technical license necessary to store it and make it available on the internet according to the nature of the service, with the Client retaining ownership and full responsibility over that content.
AI virtual assistant on WhatsApp
On our official WhatsApp number we have implemented an AI-powered virtual assistant connected to the client area, intended to help and assist the Client instantly. By writing to our WhatsApp, the Client can interact with this assistant to, among other actions:
- Identify their account from the registered phone number or email address.
- Look up their active services, domains and invoice details.
- Get general guidance about their products and about ordering new services.
The assistant runs on Capa7's own artificial intelligence, hosted entirely on our servers. We do not use third-party AI services to process these queries, so the Client's data is not sent to external platforms and stays within our infrastructure, handled in accordance with our Privacy Policy.
Regarding payment methods, the virtual assistant does not process, request or handle credit or debit card data or banking credentials. Capa7 does not store Clients' full card data: payments are made through the third-party processors listed on our Payment methods page, which transmit the information in encrypted form. If the Client needs to pay or update a payment method, the assistant will direct them to the client area or the relevant gateway; card numbers and passwords must never be shared over WhatsApp.
The assistant is offered as a complementary aid and is under continuous improvement. It may make mistakes or give inaccurate answers while it refines its language and knowledge; we work constantly to stabilize it and expand its capabilities. The information it provides is for guidance only and does not replace the official data in the client area or the attention of a human agent. For any critical information (amounts, dates, service status), we recommend the Client confirm it at capasiete.com/panel or with our support team. Capa7 is not liable for decisions made solely on the basis of assistant responses that later prove inaccurate.
Limitation of liability
Capa7 shall not be liable for indirect damages, loss of profit, loss of data, revenue or opportunities arising from the use or inability to use the services. Capa7's total liability, on any account, shall not exceed the amount paid by the Client for the affected service during the last three (3) months. The Client shall hold Capa7 harmless against third-party claims arising from their use of the services or from the content they host or distribute.
Modifications to these terms
Capa7 reserves the right to add, remove or modify any provision of these terms at any time. The version in force will always be the one published on this page, with its last-updated date. Continued use of the services after a modification implies acceptance of the new terms.
